On Wednesday October 12th 1978 Sid was charged with second degree murder remanded in custody to New Yorks Rikers Island. Seven days later he was granted bail and with his mother Ann Beverley moved into the Seville Hotel. On October 22nd Sid made his first suicide attempt. He was rushed to Bellevue Hospital where he was admitted to a Psychiatric ward.

Bellevue Hospital discharged Sid back into the custody of his mother, while a judge ordered a psychological review and allowed Sid to remain on bail on condition that he report daily to both police and the methodone clinic he had been attending. On December 9th still on bail Sid showed up at Hurrahs a new disco on 62nd and Broadway. Apparently he provoked a fight with Todd Smith brother of Patti Smith ( This could be the unintentional result of Patti Smiths reading of Anarchy in the U.K. as a poem - Yuk! ).
Smith landed a couple of punches and for his efforts got a whack over the head with a bottle. The police sent Sid back to Rikers Island. At 1p.m. on February 1st 1979 he was released once more from Rikers Island, this time completely detoxified. Clean he was not to stay. A party had been planned at the Greenwich Village apartment of Michelle Robinson an unemployed actress and friend of Sids. That afternoon and again that evening Sid shot up with heroin purchased on his behalf by his mother.
Simon had a rose pink aura around his whole body. I said , 'Jesus, son that must have been a good hit.' He was elated, quietly so. Elated on the inside, coming out, creating the aura."

"Sid promptly passed out on Robinsons bed. His mother and others placed him in the recovery position and waited for him to revive. About 40 minutes later Sid recovered and the party continued. That night Sid slept with Robinson some time before dawn he awoke and shot up again. The following morning Ann Beverley went to waken her son for his morning meeting with the police. Robinson lay asleep under the covers. Sid was on his back uncovered and lying very still.
" I felt for his pulse and there was none. After a couple of minutes, Michelle woke up and I told her Sid was dead. " Ann Beverley Death and Celebrity
It was not until after Sids cremation that Ann Beverley found a hand printed suicide note in the pocket of his leather jacket. The note was short but seemed to explain all.
" We had a death pact I have to keep my half of the bargain. Please bury me next to my baby. Bury me in my leather jacket, jeans and motor cycle boots goodbye."
Unsurprisingly the Spungens were not receptive to this wish and would not even disclose the site of Nancy's grave. Ann Beverley found the grave and one night entered the Philadelphia cemetery carrying Sids ashes. She scattered them over Nancys headstone.
